Terms and Conditions
These Terms and Conditions apply to all LifeCare Associates estimates and proposals unless a specific term is expressly superseded on the face of the estimate.
General (Applies to All Estimates)
This estimate is based on information provided to and understood by LifeCare Associates at the time the estimate is prepared. It is the customer’s responsibility to review the estimate with LifeCare Associates to confirm that the listed items, quantities, and scope are sufficient to meet the customer’s requirements. Customer approval of the estimate constitutes acceptance of the listed items, quantities, pricing, and these Terms and Conditions.
Any additional materials, equipment, or labor not specifically included in the estimate and required for completion of the work are the customer’s responsibility and will be billed as additional cost, subject to customer approval.
LifeCare Associates does not warrant or guarantee the condition, compatibility, or performance of any existing equipment reused in a new system.
The customer is responsible for providing required 110/115/120VAC power outlets for all LifeCare Associates‑supplied equipment.
The customer is responsible for contracting with and coordinating licensed fire alarm or life‑safety contractors when integration with LifeCare Associates‑installed systems is required. LifeCare Associates is not responsible for fire alarm panels, relays, inspections, certifications, or regulatory compliance unless expressly stated in the estimate.
Infection Control Risk Assessment (ICRA) equipment and labor are not included unless specifically identified in the estimate. Any such work will be priced separately based on facility requirements.
Removal or disposal of existing equipment is not included unless expressly stated in the estimate.
Installation may require cutting access openings in walls or ceilings. LifeCare Associates will limit such openings to the minimum required for proper installation. Minor penetrations may be fire‑caulked where appropriate. LifeCare Associates is not a wall, ceiling, or painting contractor. Repair or finish restoration is the customer’s responsibility unless expressly included in the estimate.
Professional Services Clarification (Important)
LifeCare Associates does not provide architectural, engineering, or other licensed professional design services.
Any programming, configuration, or field placement decisions are limited exclusively to the application of manufacturer‑published installation guidance, product manuals, and manufacturer training. These activities do not constitute professional design, engineering, consulting, or clinical services.
LifeCare Associates does not assume responsibility for system design criteria, clinical workflow, regulatory interpretation, code analysis, system performance criteria, or operational outcomes.
Door Access Control and Wander Management
Wireless transmitters may be used for remote monitoring of door equipment in alarm conditions. Where feasible, existing compatible transmitters may be reused if determined operable and compatible. Inoperable or incompatible devices will be replaced at the customer’s expense.
Existing magnetic locks may be reused when serviceable and compatible. Inoperable or incompatible locks will be replaced at additional cost.
Due to building construction variability and environmental conditions, the exact quantity and placement of door exit panels, antennas, and related equipment cannot always be determined prior to installation. Any additional components required to support system operation in accordance with manufacturer requirements will be identified and billed as additional cost.
The customer is responsible for ensuring that existing doors, hardware, alignment, latching, and mechanical operation are serviceable prior to installation.
LifeCare Associates will not open, modify, or make internal electrical connections to automatic door opener equipment. Where coordination is required, the customer shall provide appropriate request‑to‑exit (REX) connections and operating instructions.
Wander management frequencies may be adjusted based on site‑specific frequency analysis.
If voice dialers are used, the customer shall provide active, properly configured analog telephone lines and required power outlets.
Where elevator integration is required, the customer is responsible for engaging a qualified elevator contractor to complete final connections. Additional visits required due to elevator contractor unavailability will be billed to the customer.
Nurse Call Systems
Wireless nurse call systems are subject to environmental and construction conditions. Due to building materials, layout, and wireless interference, the exact number and placement of repeaters may not be fully determinable prior to installation. Additional repeaters required to meet manufacturer installation parameters will be added as necessary and billed accordingly.
The customer shall provide an active LAN/WAN connection accessible to nurse call servers as required. A static IP address will need to be obtained from the customer’s IT personnel for the TekTone server.
LifeCare Associates does not configure, manage, or modify nurse call systems not sold or serviced by LifeCare Associates.
The customer is responsible for providing compatible mobile devices and for maintaining wireless network capacity, speed, and reliability sufficient to support nurse call applications.
Installation will generally proceed room‑by‑room where practicable to maintain continuity of existing nurse call services.
If the Remote Access Server annual subscription is included in this quote, the customer must allow the introduction of a remote access server onto the same wired LAN subnet the TekTone server is connected to. The Remote access server must be granted access to the internet via the Customer’s wired LAN to allow LIFECARE ASSOCIATES to connect remotely to the nurse call server for troubleshooting and configuration.
The customer must provide available 110VAC outlets located in with 3′ of a designated installation point for monitors, wireless repeaters, the nurse call system server or appliance, and supporting modules.
Floor‑Based Patient Lifts (Equipment Sales Only)
LifeCare Associates may resell certain floor‑based patient lift equipment and accessories. Unless expressly stated otherwise in the estimate, LifeCare Associates’ role with respect to such equipment is limited to the sale or delivery of the equipment and does not include installation, certification, inspection, training, maintenance, or clinical evaluation.
The customer and end user are solely responsible for:
- Reading, understanding, and following all manufacturer instructions, warnings, operating manuals, and maintenance requirements
- Proper use, operation, inspection, and ongoing care of the equipment
- Ensuring that all operators are appropriately trained and qualified
- Compliance with applicable safety practices, facility policies, and regulatory or accreditation requirements
LifeCare Associates does not control how floor‑based lift equipment and accessories are used after delivery and does not warrant or guarantee safe operation beyond any applicable manufacturer warranties. LifeCare Associates is not responsible for accidents, injuries, or damages arising from misuse, improper operation, failure to follow manufacturer instructions, lack of maintenance, or use of the equipment by untrained or unauthorized persons.
Manufacturer warranties, if any, apply exclusively to the equipment and are provided by the manufacturer, not by LifeCare Associates.
Limitation of Performance Responsibility
LifeCare Associates does not guarantee system performance, response times, coverage sufficiency, reliability under all conditions, clinical outcomes, or suitability for any particular use or facility operation.
LifeCare Associates’ responsibility is limited to furnishing and installing equipment in accordance with manufacturer requirements and the standards of workmanship customary for contractors performing similar work.
Warranty
LifeCare Associates warrants its workmanship for one (1) year from the date of installation completion. Manufacturer warranties apply separately to equipment and components.
Version Control
These Terms and Conditions are those in effect on the date of the estimate or proposal and shall not include subsequent revisions unless expressly agreed to in writing.
